1115 Research & Demonstration Waiver and Independence Plus


General Requirements for Independence Plus (IP)

For purposes of completing this application, all policies pertaining to IP programs, self-directed care and Quality Management systems contained in the Section 1915 (c) application, instructions and guidance thereto, apply in a Section 1115 IP application.  Therefore, applicants must review the Section 1915 (c) waiver application for guidance in the preparation of a Section 1115 IP demonstration program. Demonstration Application Process

When completing a Section 1115 Independence Plus (IP) new application, or an amendment to an existing demonstration, a State's application needs to address all the CMS requirements for IP contained in the Section 1115 IP template, which includes the template and the budget shell.  There are budget instructions and "model" Special Terms and Conditions of Approval for your reference and guidance in completing your application.  (See the link below.)  As noted above, a State needs to also incorporate the self-direction and IP policies that are detailed in the Section 1915 (c) waiver application.

Only State Medicaid Agencies may apply for Section 1115 Demonstration programs.CMS often provides informal consultation and technical assistance to a state prior to the formal submission of an 1115 IP application.  States may, at their discretion, submit a concept paper and/or a "draft" proposal, in order to develop a clearer understanding of the IP and Section 1115 requirements.  States may submit an IP concept paper or application to Terry Pratt at Theresa.Pratt@cms.hhs.gov.  She will then assign it to the appropriate Project Officer.

Once the state's application is submitted, CMS convenes a "review team" comprised of Medicaid staff, agencies within the Department of Health and Human Services and the Office of Management and Budget.  There is no "90-day clock" as in the Section 1915 (c) waiver application, but CMS strives to secure concurrence from the review team and to reach a decision as expeditiously as possible. 

Once the program is approved, the State will be required to adhere to the Special Terms and Conditions of Approval.  The State will also be required to prepare an Operational Protocol document, which represents all of the State's policies and operating procedures applicable to the demonstration.  The State will be required to submit the Operational Protocol to CMS for approval prior to implementation of the demonstration.
