Section 1886(j) of the Social Security Act authorizes the implementation of a per discharge prospective payment system (PPS) for inpatient rehabilitation hospitals and rehabilitation units. Each facility must show that during its most recent, consecutive, and appropriate 12-month time period (as defined by CMS or the fiscal intermediary), it served an inpatient population of whom at least a certain percentage required intensive rehabilitative services for the treatment of one or more of the conditions discussed in the Code of Federal Regulations (42 CFR ยง412.23(b)(2)).
