Whether it is proper for Noridian Healthcare Solutions (the "Medicare Contractor") to use a statewide average cost-to-charge ratio ("CCR") for the calculation of Kaiser Health's ("Kaiser", each Kaiser hospital individually a "Hospital" and collectively the "Hospitals") outlier payments for fiscal year ("FY") 2016 or whether, instead, the Medicare Contractor should have reconciled the Hospitals' outlier payments, using each Hospital's actual CCR, during the cost-report settlement process.
