1. Whether the Provider has demonstrated that it is entitled to a hearing before the Board because there is $10,000 in controversy. 2. To what extent, if at all, Medicare's $720,991 demand for repayment from the Provider for fiscal year 2006 would be decreased if the Provider's proposed manner of calculation of the amount in the hospice cap is adopted in lieu of the Intermediary's calculation which was issued pursuant to the existing regulation.
